Notice to organizations who are seeking the services of a licensed fund raising counsel.


Many states have laws regulating the solicitation of funds for charitable purposes. These statutes generally require organizations to register with a state agency before soliciting the state's residents for contributions, providing exemptions from registration for certain categories of organizations. In addition, organizations may be required to file periodic financial reports. State laws may impose additional requirements on fundraising activity involving fund raising counsel or consultants.

Many of these states define "fund-raising counsel or consultant" as "any person who meets all of the following:
  1. Is retained by a charitable organization or sponsor for a fixed fee or rate under a written agreement to plan, manage, conduct, consult, or prepare material for the solicitation of contributions in this State.
  2. Does not solicit contributions or employ, procure, or engage any person to solicit contributions.
  3. Does not at any time have custody or control of contributions."
